The Casebook will at any rate have to deal with the following subjects:
- Introductory Chapter, setting out the concepts of direct and indirect horizontal effect and presenting a general overview of the subject matter of the casebook (including the caselaw mentioned above insofar as it will not be described in the introductions to the chapters devoted to specific subjects);
- Competition law: art. 101 and art. 102 TFEU (in particular art. 101 para. 2 and its consequences for contract law and tort law), concentrations regulation, horizontal effect of provisions on state aid);
- Fundamental freedoms and their effects in private law;
- Treaty provisions containing prohibitions of discrimination and their effects in private law;
- General principles of Union law containing prohibitions of discrimination and their effects in private law;
- Other general principles of Union law and their effects in private law;
- Ex officio application of Treaty provisions (in particular art. 101 para 2 TFEU) and of provisions of directives (in particular art. 6 directive unfair terms in consumer contracts) concerning nullity of contracts or of contract clauses.
